1) CONDITIONS OF ENTRY

a. REFUSAL OF ENTRY
Entry will be refused or you may be requested to leave the studio if:

i. You are using abusice or threatening language or behaving in a thretening way.

ii. You are under the influence of drugs or alcohol.

b. NON-SMOKING
Taylor Made Transformations is a non-smoking facility.

c. DRESS CODE
Fully enclosed, clean sports shoes must be worn during workouts for safety reasons. Members are required to wear a singlet or t-shirt at all times in the studio.

d. TOWELS
Please use a towel when participating in classes and when exercising on gym equipment to maintain hygeine and safety standards. Hiring of a towel can be arranged for $3.00 or towels are available for purchase at reception.

e. PIGEONHOLES
Pigeonholes are available for convenience and are located in the Functional Training Zone. It is your responsibility to look after your personal items. Taylor Made Transformation’s employees and/or contractors take no responsibility to any loss or damage to personal property. It is advised that you keep all valuable items with you while using the studio.

2) USE OF EQUIPMENT

Within the Functional Training Zone, you must seek assistance from our Coaching Staff if you are unfamiliar with the safe use and/or operation of equipment or an exercise. You are required to return all equipment to the correct storage area after use.

3) LOST PROPERTY

We highly recommend that you use the supplied pigeon holes for your belongings. Taylor Made Transformations do not take responsibility for any loss or damage of your belongings. Any items of clothing left behind at the studio will be help for two weeks, and then donated to charity.

4) MEMBERSHIPS

a. ENTITLEMENTS
Membership entitlements at Taylor Made Transformations differ depending on your membership plan.

Gold Membership entitles you to:

i. Participate in an unlimited amoutn of Semi-Private Training Sessions
ii. 2 x 30 minutre Personal Training Sessions per week.
iii. 6 weekly measurements and fitness assessments
iv. Lifting Party Access

Silver Membership entitles you to:

i. Participate in an unlimited amoutn of Semi-Private Training Sessions
ii. 1 x 30 minute Personal Training Session per week
iii. 6 weekly measurements and fitness assessments
iv. Lifting Party Access

Bronze Membership entitles you to:

i. Participate in an unlimited amount of Semi-Private Training Sessions
ii. 6 weekly measurements and fitness assessments
iii. Lifting Party Access

Wellness 4 Mum’s Membership entitles you to:

i. Participate in 2 x Wellness 4 Mum’s sessions plus 1 additional sessino of choice from the TMT Timetable
ii. Before and after photos and measurements

Corporate Membership entitles you to:

i. Participate in an unlimited amount of Semi-Private Training Sessions
ii. 6 weekly measurements and fitness assessments
iii. Lifting Party Access

b. OBLIGATIONS
Membership at Taylor Made Transformations requires you to:

i. Update your contact details when they change.
ii. Comply with all Terms and Conditions and the guidelines in this document.
iii. Pay all agreed fees, ensure sufficient finds are available to cover all fees and advise us in advance if your bank account or credit card is closed or changed.
iv. Inform us in advance of any medical conditions you have or if there are any risks to your health if you participate in fitness services and if required seek approval and provide written clearance from your Doctor or Health Professional.
v. You acknowledge that it is your responsibility to cancel direct debits facilities in respect of your membership when this Agreement expires or is teminated.

c. TAYLOR MADE TRANSFORMATIONS ENTITLEMENTS

i. Taylor Made Transformations reserves the right to make changes to exercise equipment supplied in the Studio at any time. Taylor Made Transformatinos reserves the right to make changes to the Small Group Personal Training timetable and opening hours at any time. (i.e. alter class type, times and instructors).
ii. All entitlements and entry into Taylor Made Transformations will be revoked if a members account is in arrears.
iii. If your automatic direct debit is revered or returned to us by your financial institution, we will attempt to retry the debit. If the debit remains outstanding, it will be processed within 14 days of the reversal with any reversal and late fees that apply. If you fail to pay us the fees by the due date, we are entitled to refuse you entry into the Studio. If unpaid fees remain outstanding and after attempts by us to rectify the arrears, your membership may be forwarded to a collection agency for further action.

d. CHANGES TO CONDITIONS
Taylor Made Transformations reserves the right to change the conditions contained in clause 5 by providing you with one months advance written notice of any changes.

3) CANCELLATION / TERMINATION

a. PERMANENT SICKNESS OR PHYSICAL INCAPACITY:
1. Taylor Made Transformations require a written cancellation request advising the nature of the illness or physical incapacity, outlining specifically how this prevents you from utilising any of the services or facilities that Taylor Made Transformations is able to provide.
2. Taylor Made Transformations requires a medical certificate stating that you cannot utilise any fitness services or facilities because of your permanant illness of physical incapacity.
3. Taylor Made Transformations may agree to cancel the membership upon payment of a cancellation fee of $199.

b. CANCELLATION FOR ANY OTHER REASON

1. Taylor Made Transformations requires that an emailed written cancellation request form be completed and requests must be directed, at the first instance, to Taylor Made Transformations.
2. A Cancellation meeting will be arranged between you and Talor Made Transformations to attempt to find a solution for the cancellation of your membership and sign a cancellation form.
3. Cancellation within Minum Term: You may terminate this Agreement before the expiry of the minimum term (or payment amount) if all instalments and fees due up to the date of temination are paid and the relevant cancelation fes are paid in full at the time of cancellation request. The cancellation fee if more than 6 months remains of the minimum term of the agreement $545 and if there is less than 6 months remaining of the minimum term of the agreement is $295.
4. Cancellations after the completion of Minimum Term: There will be a period of notice of 30 days, unless otherwise specified, from the date of cancellation request to the date of termination, during which any payments that fall due must be paid in full. The notice period will exclude any suspension or payment break applied to your membershiop. Any instalments/fees due at the date of termination (including instalments/fees which fall due during the notice period) will remain as debt owed to and recoverable by Taylor Made Transformations. The member shall not consider this agreement has been terminated until such time as this is confirmed in writing to the member by Taylor Made Transformations (not more than 14 days after the termination date). Termination of this agreement will also terminate the Direct Debit Request Authority.
5. Ongoing Membership Agreements: After the expiry of the minimum term payments, and after all instalments and fees due have been paid in full, termination of this membership agreement after the minimum term will require a 30-day notice period.

c. TERMINATION BY TAYLOR MADE TRANSFORMATION
Taylor Made Transformations reserves the right to terminate this membership agreement in accordance with the following conditions:

1. Failure to abide by any of the criteria listed in this agreement.
2. Action upon a complaint by either a Taylor Made Transformations member or an employee (or contractor) of Taylor Made Transformations.

6) TRANSFER OF MEMBERSHIP BY THE MEMBER

At our discretion, a Taylor Made Transformations 12-month direct debit membership’, while within the minimum term, may be transferred to a non-member for a fee of $75.00. Transfers are subjext to special criteria in addition to normal membership guidelines which are avilable upon request. The term of this agreement and the Studio that the membership is associated with remain unchanged.

7) DAMAGE & PERSONAL INJURY

To the extent permitted by law, Taylor Made Transformations excludes any liability to the Member in Agreement, tort, statute or in any other way for any injury, damage or loss of any kind whatsoever (including, without limitation, any liability for direct, indirect, special or consequential loss or damage), sustained by the Member and/or any other person, or for any costs, charges or expenses incurred by the member arising from in connection with this Membership Agreement and/or the services/products provided by Taylor Made Transformations and/or any act or omission of Taylor Made Transformations.

8) SAFETY, MAINTENANCE & SERVICE DEMAND

From time-to-time Taylor Made Transformations may be required to make changes to the operation of the premises, including:

a. Changing the availability of the facilities or services within the studio
b. Closing off part of the premises or equipment maintenance for safety reasons.
c. Changing conditions of Entry or Studio Rules.

Where this occures, Taylor Made Transformations will provide reasonable notice within the Studio.

9) SUSPENSION

Suspensions are available for a minimum of one week and a maximum of 4 weeks per year. A suspension request must be emailed at least 10 days before the period requested and cannot be backdated. Suspensions are not calculated in the minimum term of the contract.

10) PAYMENT BY DIRECT DEBIT

If paying by Direct Debit, the Member agrees to pay the instalment amount at the agreed payment frequency until this Agreement is terminated in accordance with Clause 5. Should there be any payments owing in arrears, the member authorises Taylor Made Transformations to debit the outstanding balance in order to bring the account up to date.

11) PRIVACY

A customers “personal information” (as that term is defined in the Privacy Act 1988 (Cth)) will only be used by Taylor Made Transformations to provide you with the services outlined in this agreement.

12) DEBT COLLECTION AGENCIES

If paying by direct Debit, upon default by the member in regard to any obligation under this Agreement and failure to remedy the default after notification by Taylor Made Transformations, the member authorises Taylor Made Transformations to notify any debt collection agency of the default. Should this occur, then at Taylor Made Transformations sole discretion it may terminate the Agreement at which time the full outstanding balance for the remainder of the minimum term or payments (including any current arrears) shall by debited in full.

13) INCREASE IN FEES

If paying by Direct Debit, Taylor Made Transformations may at any time after the end of the minimum term, upon sending written notice to the Member’s last known address and giving 14 days’ notice, increase the instalment amount. If the Member wishes to terminate this Agreement as a result of the increase in the instalment amount, the member must notify Taylor Made Transformations in writing within 14 days of the date of the written notice sent by Taylor Made Transformations. The Agreement will be terminated upon receipt of this notice. If the member does not notify Taylor Made Transformations of its intention to terminate this Agreement within such specified time period, then this agreement will remain in force and the increase in the instalment amount will be deemed accepted by the Member.

14) ENTIRE AGREEMENT

This Agreement, and DDR Service Agreement (if paying Direct Debit) constitue the entire agreement, understanding and arrangement (express and implied) between the Member and Taylor Made Transformations relating to the subjext matter of this Agreement and supersedes and cancels any previous agreement, understanding and arrangement relating thereto whether written or oral.
